Nicholas Randall is the chairman of Forest, Marinakis is the owner.
Daniel Levy is the chairman of Spurs, Enic are the owners.
The two chairman agreed on the MGW deal, hence Gibbs-White was on his way to have a medical at Hotspur Way, then the owner got involved and blocked the transfer, sighting "misconduct" on Spurs/Levy's part.

If this is how it played out then surely the Forest owner doesn't have a legal leg to stand on?

Nah fuck them. Lawyer up and make it so we enforce MGW's release clause in the final hour of the window and leave Forest without their best player or a replacement.

It's in no ones best interest for this to drag on, but the biggest losers will be Forest if it does. It's going to take them a while to find a replacement and after this debacle, no self respecting player is going to want to play for a club who do not honour release clauses.

That wouldn’t benefit us - he misses the first few games for us and then we have to try to integrate him when the season has started.

Is MGW really worth all this hassle? I get he is a good player but I’d much rather pay a bit more for Wharton
 
Well then there's your technicality...
Because as everyone knows, we finished 17th, so in the eyes of all other 19 PL clubs we didn't legitimately qualify for the CL...we snuck in through the back door, and has been officially agreed by Sky, BBC, TalkSport and AFTV we don't deserve to be there!

So THAT'S why Forest are questioning the validity of masquerading as a CL club!

You’re overthinking. Forest I’m sure have paperwork on their end and they just are holding it all up. He’s technically still their player.
They have shown their hand crystal clearly here.

Any step which they must take to legitimize the transfer will NEVER be taken under any circumstances short of active legal compulsion.

Spurs and Gibbs-White force the matter, or there is no matter and never will be.

Seems feasible based on what been know, or think we know anyway.

Problem is, even if we're in the right legally, Forest just obstinately refusing to do their part can seemingly prevent this deal from going through well beyond the deadline.

Unless the PL steps in of course, but I'm dubious as to whether they would, and if so, whether it would be in a timely enough manner for us.

Given that Forest are not only refusing to play ball, but have themselves actually lodged a complaint, you'd think there could be more to the story.

But, it could just be the owner being a massive child and their complaint is utter tosh.
 
I have to add some balance because clearly SOME of you fellas aren't interested in it & are just resulting in calling our owner fat & commiting libel (the usual tiresome response).

The club would not be complaining if it wasn't illegally triggered, we are not "dragging it out", we don't want to sell him & never had unless it was for stupid money. I know you like to think Levy is the worlds best businessman but we think highly of our owners ability to control deals ourselves, and he is much more popular here than Levy is at your place because of his desire to not allow people to shit on the club.

I think the reality of this situation is Levy has tried to pull a slick one & activate a clause without knowing the fine print of the contract. Levy should have contacted the club & done it by the book, it might work at other clubs where you can poach players but as pointed out above, our owner will act if he thinks he's getting shafted. There was no clause reported until a week ago, and within 5 minutes he had a medical booked.

Nobody knows the fine print in the contract, that is why any technical discussions are pointless. But Forest wouldn't be taking it to the courts out of pettiness. This situation is so rare because things are normally done professionally & by the book. In my personal opinion of how this plays out is Spurs will end up withdrawing their bid as the outcome of an illegal is not worth the bother for you. Sorry to dampen on your parade, but Levy has fucked this up. Not Forest.

Mate are you talking about the alleged Criminal that owns Forest. Who tried to sue Gary Neville after he correctly said you should not lambast your manager in public? All while your owner had his shares in trust and should have had no involvement in the running of the club?
 
It is written into his contract that after 100 pages on TFC he is officially ours

The Forest owner has previous tantrum experience. I doubt there is any legal basis other than saving face.
 
The owner has thrown his toys out his pram. Welcome to the premier league! The land of sharks. End of the day apparently Gibbs-White has told them he wants to leave and not renewing his contract. He wants to come to the bright lights of London and not stay in a city where they talk about robin hood all the time. Must get boring after a while. :)

All speculation of course, but if both chairman agreed the deal I can't see how a complaint about the clause being leaked can supersede that, as it is widely accepted that these type of scenarios (tapping up) happen all the time and to find in Forest's favour would open up a whole can of worms going forward for future transfers.

I stand to be corrected, but there is 100% no way imo that Daniel Levy only dealt with and arranged MGW's medical, with just MGW's agent and the player himself. No way whatsoever! Daniel Levy and Nicolas Randall would have spoken and agreed the 60m buyout and therefore sanctioned MGW's medical.
It's only when your chairman got wind of it and overruled his own chairman who he put in charge to run the club on a day-to-day basis and make decisions like this, is when the shit hit the fan.
Forget about the tapping up your owner is trying to use to prevent this transfer, because tapping up is part of the professional game in one form or another and to have a charge proven (unlikely) and acted upon would open up a whole can of worms going forward for future transfers.
