That was different. Atletico had a clause in the loan that they could "Buy Back" the buy option for 1.5m. Southampton believed there was an end date to this and the end date had passed when Atletico activated the clause.
It was Southampton's own fault, as they could have activated the but option the month prior but for what ever reason didn't.

According to L’Equipe, Chelsea actually made a late play to sign Mathys Tel before he arrived in N17 to sign for Tottenham on loan until the end of the season.Tottenham signed Tel with an option to buy, an exciting youngster who Bayern Munich didn’t expect to lose at the beginning of the window.
But according to the report, Chelsea tried to hijack Tel’s loan move to Spurs when he was waiting at the airport to fly to London.
Unfortunately for Maresca’s side, it was too late and Tel had already chosen a move to north London.
Of course, Spurs’ rivals Woolwich were also interested in a move for Tel in the final days of the window.
But ultimately Woolwich decided not to pursue Tel, a club who have gambled on the fitness of Kai Havertz for the rest of the season.

Whilst I wholly agree that Levy has never grasped the nettle and really tried to “win now”, the fact we monumentally fucked up the end of Poch and the next five years, to the point where Kane was gonna leave one way or another meant there was no short-term fix. We had to build a brand-new team and doing that takes time unless you have a sovereign wealth fund.
My problem is more with if, and it’s a big if, this squad full of young talent matures and starts peaking together, Levy won’t make the Alisson and VVD, or Declan Rice type deals need to help push the whole thing on.
