Their complaint is that he's been stating publicly that Forest is his team forever (etc) whilst behind closed doors he's been refusing to enter into a new contract - then this has blown up and many fans think he's the catalyst.
One suspects they will come around when it becomes clear how effectively they've mugged off Spurs here, though crushing this deal does not solve their Gibbs-White problem over the longer term.
 
So can someone tell me if the release clause has been met or is met also by another club why he can't say yes I want to go no hard feelings and he says he wants a new challenge. Else why would a release clause be in a contract.
Hence why Forest have come up with the tapping up / breach of confidentiality claims. The clause is legit, but this nonsense muddies the waters enough to allow them to stall, even though tapping up and sharing contract details must happen all the time.

I feel like Spurs maybe fumbled this, if they went in cold with an offer matching the release clause, rather than informal talks to prepare the ground, so that when the bid came in Forest accepted what was going to happen. But who knows what really happened, Marinakis seems less than rational at times.

Unlike some bootlickers on here I don't think Levy has some masterplan and that this will be resolved in a couple of days.

I think we've fucked up somehow and the reporters have jumped the gun with the medical stories on Friday. Forest are clearly in control here and that means we have not properly activated the release clause or it has become void due to our wrongdoing.

Nope. Forest not cooperating with the transfervdoes not mean they are In control.

Most serious football commentators still believe he will come to Spurs once Forest realise they do not have a leg to stand on.

Might take time to happen which is inconvenient but not fatal.

Forest problem Is that player has refused to extend contract and makes it clear he was ants out. So Forest have an unhappy player and no obvious exit route out of this problem atm

The only person with the legal right to compel Forest to proceed with the transfer per the release clause is Morgan Gibbs-White, and due to some combination of unwillingness to exit the club on bad terms and he and his representation fearing further action regarding the breach of confidentiality around the release clause, he has blinked and is not treating this as the violation of his contract that it is.

Barring total reversal of Gibbs-White's attitude, this is over.

If he hasn’t then we need to ask him if he’s prepared to burn them. If he isn’t then the move is off and we move on.

Forest problem Is they had to put release clause into contract to get player to sign when he joined. So Forest must have realised it would be exercised

The other problem for Forest is any other player thinking of joining Forest will worry they can never leave given Forest behaviour over Gibbs White

It depends if it was a voluntary breach of the NDA or an induced one. In either case, civil action can be taken against either the player, agent or both, depending on circumstances, if it was a response to an inducement or if Spurs were aware that it should not have received this information, then you can add Spurs to this. In any case, all parties could be liable in a breach of confidence action. The possible remedies could include damages and the purported contract arising from the leak being set aside.
If the parties have released this information into the public domain and this causes a loss arising from this to the selling club, then the selling club could take action against those involved in releasing the information into public domain for consequential loss.

Incidentally, Gibbs-White is represented by the same agency as Ben Davies.

Gibbs-White is represented by CAA Stellar, not CAA Base (exactly how connected the two are, I'm not sure)
