i do think forest are doing irreparable damage to their reputation with this whole fiasco regardless of what the outcome is. no one will do a release clause with them again and i'm guessing these are more common with smaller clubs chasing better players.

The worst thing that could happen to us is the Club gets its knuckles rapped for not asking permission to speak to the player or his agent (none of the other stuff is provable).
The worst thing that could happen to Forest is MGW stays there and the club's reputation is badly damaged in the eyes of potential recruits. To be honest - that's already happened.

Something to think about though.

Since we did the legal thing and put the 60mil offer to activate the release clause, surely, they cannot sell him to another club for the same amount or less. We were the ones who activated the release clause and unless the player himself does not want to play for us, they must sell him to us then, not any other club offering what we offer.
They can sell to any club they wish, and for less if they wish.
All meeting a release cause means (providing met legally) is they cannot refuse our offer, but that does not mean exclusivity, others can bid same, more or less, and player can talk to anyone that meets clause and also anyone that Forest allow them to talk to (even if they bid lower)
 
I can’t see in any way shape or form Ange telling Marinakis anything, as it is very unlikely he would have known it anyway (were we even looking at MGW when Ange was here ?)

Much more likely CAA Base would have access to MGWs contract through their sister company and advised us accordingly.

I'd love it if it transpired that Marinakis had told Ange last season what MGW's exit price was and that's how Spurs knew. The fat cunt could sue himself then, couldn't he?

A major agency like CAA Stellar have significant power in the footabll world (as the charts posted earlier in this thread demonstrate). Their role is to act in the best interests of their clients, football players, whilst making as much money as possible.

Release clauses have become more frequent in recent years because they give players, and their agents, more power to move even where a club doesn't want to sell.

Morgan Gibbs-White has outperformed his contract, and is now worth more than the alleged £60 million release fee. Forest are briefing they tried to renegotiate the contract, presumably to increase or remove the clause, and MGW declined their offers.

Tough shit. Club and player signed the original contract, and it's likely neither MGW or the agents would have agreed to sign without the release clause. Now MGW wants to use that clause to move to a bigger club. This is not analogous to a player walking on a free transfer, because Forest get a very large, pre-agreed, sum of money.

It is in the interests of ALL agents that release clauses are respected by clubs. CAA Stellar have the clout to make Marinakis understand he can't unilaterally ignore the terms of a contract freely entered into by club and player. Otherwise, contracts become worthless,

Now that Forest have allegedly formally written to Spurs and the agents, the nature of their claims should be clearer. Unless there's hard evidential proof of something which Levy & CAA Stellar believe places them in a legally vulnerable position, I think all we're seeing is Marinakis' stinky flatulence, as his huge ego gets punctured.

We shall see.

MGW is not just technically good, he has a great football brain. He will improve our first team, and I hope this gets done sooner rather than later.
 
There is precedent set in the premier league -


In 2002, Liverpool Football Club was fined £20,000 by the Premier League for an illegal approach for Christian Ziege, who was then at Middlesbrough. Ziege himself was also fined £10,000 for his part in the transfer. Middlesbrough had claimed Liverpool illegally approached Ziege, who had a release clause in his contract, and that they could have sold him for more than the £5.5 million Liverpool paid. The blind trust got revoked as soon as Olympiacos and Nottingham Forest did not end up in same European competition for next season.

This is exactly right and there are only two possible reasons CAA Stellar weren't screaming bloody murder on every TV show in the country first thing Friday morning:

1. They've done something wrong
2. Their client doesn't want to fight this

Either way, Forest wins.
 
not pointless. it's a threshold not a price tag. club agrees to sell if bids cross the line and player agrees to not reveal the number. i could see that reasonably being agreed to
Very true, in much the same way a reserve price is set for an auction item. Others can still bid higher, but in this case, whatever sum is bid, it is up to the player to decide which bid is accepted rather than just the highest bid.
 
There is not, can not, and will not be any settlement. Forest have made that crystal clear.
You must be real easy to play cards against. I say he leaves Forest this window. With the chances he comes to Spurs 80% the likelihood he stays at Forest is slim to none. He had a contract with a realse clause, it's been triggered, if they say we approached him illegally the onus would be on them to prove it. Not shout about it prove it. If they had this they'd have already briefed a friendly journalist that they are strapped. They haven't. Gibbs-white will insist he wants to leave they get a replacement and then they will sell him.
